The Ministry of Development and Technology announced that no more than two-storey detached houses with a building area of more than 70 square meters will be allowed to be built without a building permit. The House of Representatives adopted regulations on the matter on Thursday.
On Thursday, the House of Representatives passed a law on the principles for granting guarantees from the state treasury for the obligations of the National Energy Security Agency, along with amendments in the field of construction. These amendments concern, among others, the following: Exemption from the obligation to obtain a building permit for houses of more than 70 square metres, as is the case today with houses of up to 70 square metres. Home shelters up to 35 square meters and booths with a building area of no more than 15 square meters.
Building without a permit
We are expanding the list of establishments exempted from the obligation to obtain a building permit. It will include, among other things, single-family homes with a built-up area of more than 70 square meters. In practice, this means that the construction of such a house can start almost immediately after a simple notification is sent to the office and the construction supervision is notified about the start date of the construction work – Minister of Development and Technology Waldemar Boda noted.
As indicated by the ministry, the amended regulations exclude the possibility of the Architectural and Structural Engineering Management Authority objecting to the notification of the construction of such a house. He added that the obligation to appoint a construction manager and maintain a construction record would remain in place. The Ministry pointed out that the option to build on the basis of a simplified notification applies only to separate residential buildings that do not exceed two floors and consist of two floors, with a built-up area of more than 70 square meters, and the area of its entire impact on the plot of land on which it was designed, and construction is carried out in order to meet Investor’s housing needs. Thus, this house must be built for its own housing needs and not for sale or rent. – This is the type of house that is being built in our country the most. That is why, on my initiative, the General Office of Building Control is conducting an architectural and construction competition for house designs of 120, 150 and 180 square meters. The designers had time to submit contest entries until July 31 of this year. Submissions will continue to be evaluated until September 5 of this year. As a result, this year we will offer free downloadable new projects to all interested parties, – reported Minister Boda. Deputy Minister Pyotr Ochinsky added that simplifying and accelerating the investment and construction process is one of the government’s priorities. Today we are taking another step in this direction. Ochinsky said that amending the building code would reduce the burden on both investors and the architectural and construction governing bodies.
The approved regulations state that without a building permit it will be possible to erect, among other things, home shelters and temporary hiding places with a usable area of up to 35 square meters, designed to protect the users of a single-family apartment building from the effects of threats, for example military. In addition, it allows persons holding a professional title of technician, professional diploma or diploma confirming professional qualifications in the profession taught at technician level to obtain a limited design license. The regulations also expand the rights of persons with building qualifications in the architectural specialization to a limited extent.
The approved amendments to the NABE Law also relate to the changes made to the Law on Facilitating the Preparation and Implementation of Housing Investments (the so-called Private Housing Law). They remove for example the requirement to specify the minimum number of parking spaces in a residential investment, which is at least 1.5 times the number of apartments to be built, and in the case of an investment in a city center development – the minimum number of parking spaces, at least equal to the number of apartments that will be built. will be built.
The following modifications adopted concern the purchase of apartments under the Mieszkanie Plus programme, announced by the government. They define, among other things, the persons entitled to redemption and the rules for it. It was envisaged that it would be possible to “take ownership” with state subsidies of the installments of the sale price of the apartment. Subsidies will not be due for more than 300 installments.
The NABE Act, along with building-related changes, will be referred to the Senate for consideration.
